    The Criminal/Penal Law Practice

    We have been operating on the Polish market for 10 years. We are an independent law office created by people closely connected with the Faculty of Law and Administration of the University of Warsaw. Our team consists of nearly 40 lawyers, 9 of whom also possess a doctoral degree in law.

    Our clients include leading Polish and international enterprises, as well as public institutions.

    We have extensive experience regarding the provision of services for the participants of the energy market, the widely understood rail and aviation industry, the food sector, and organizational units of territorial self-government, as well as professional self-governing bodies. We provide complex services connected with investments in the area of the real estate property business, property transactions, circulation and management, as well as also consultancy and advice regarding the protection of cultural heritage.

    We specialize in legislation and regulated activity. We are experts on issues relating to economic law, company-related law, labour law, intellectual property law, penal law, including penal and economic law, consumer protection law, as well as state aid, public procurements and public and private partnership law. We also provide advisory services on litigation proceedings.

    The Criminal/Penal Law Practice 

    We represent our Clients in criminal, penal fiscal and offence proceedings on the pre-trial stage of the proceedings and on the judicial stage of the proceedings. We run a defence at the executive criminal proceeding stage in relation to early releases from serving a sentence, intervals in serving a sentence, deferment of sentence, and we also represent detained persons, etc.

    Regardless of the above, we operate on the foreground of proceedings through the provision to entrepreneurs of legal advice on the effective elimination of threats resulting from widely understood entrepreneurship, which could lead to criminal/penal or fiscal penal responsibility. We conduct audits and identify potential criminal/penal and fiscal penal threats connected with running business activity.

    We represent victims, subsidiary prosecutors, private prosecutors, and claimants in criminal and penal proceedings.

    We also prepare and conduct bespoke trainings regarding the criminal and fiscal penal area.

    Our experience also extends across the following issues:  

    • Ongoing legal representation of PLL LOT S.A. and Operator Logistyczny Paliw Płynnych Sp. z o.o. (the Liquid Fuel Logistic Operator) at the pre-trial stage as well as before prosecuting authorities, common courts and the Supreme Court in criminal and penal cases, including appearing on behalf of victims.
    • Drawing up legal analysis for the Liquid Fuel Logistic Operator concerning possible consequences and proposed measures with regard to press infringement of personality rights and on the impact on the interests of the entrepreneur.
    • Drawing up legal analyses for PGE Górnictwo i Energetyka Konwencjonalna S.A. related to the obligations arising from participation in capital group bodies in the context of criminal and penal responsibility.
    • Ongoing legal advisory and representation services before judicial bodies in criminal and penal proceedings of the following companies: Proscenium Sp. z o.o., Magnum – X Sp. z o.o., and AB Industry Sp. z o.o.
    • Training for members of the management board of PKN Orlen S.A. regarding legal and penal issues related to performing the function of a member of the management board of a capital company. 
    • Training for Polska Grupa Energetyczna S.A. on the subject of legal and penal issues related to performing management functions in capital companies.
    • Training related to legal and offence proceedings for SBM sp. z o.o. with its registered office in Wrocław.
    • Training for members of the management board of Grupa Azoty Zakłady Azotowe Kędzierzyn Joint Stock Company on legal and penal issues related to performing management functions in capital companies.
